Change of purpose of plots restored

The possibility of changing the purpose of land plots has been temporarily extended again, President Volodymyr Zelenskyy signed a bill that provides, among other things, for the postponement of the obligation to develop spatial development plans for communities from January 1, 2025 to January 1, 2028 (No. 5949).

In parallel, work will continue on preparing for the second reading of bill No. 13437, which details the deadlines depending on the communities - rear or front-line affiliation.

That is, citizens and legal entities again have the opportunity to apply to local governments for permission to develop detailed plans, now owners of agricultural land plots have the opportunity to change the purpose of their plots for the construction and maintenance of a residential building and for other types of purpose.

This innovation will revive the real estate market, namely land plots, this provision of the law will be in effect until January 1, 2028 for the rear regions of Ukraine in accordance with draft law No. 13437 on the transfer and clarification of the terms of obligation for communities of comprehensive spatial development plans (SDP), therefore I recommend that land owners do not put plans for changing the purpose of their plots in a long drawer.

How to make a detailed plan of the territory, how to change the purpose of a land plot

To obtain permission, land owners need to apply to the local government with an application for permission to change the purpose of the land plot and develop a spatial development plan, have with them: title documents for the land plot, passport, code if the plot does not belong to the applicant, a power of attorney from the owner.

The cost of developing a DPT and a feasibility study (FES), which is part of the documentation for changing the intended purpose, starts from 60 thousand UAH.

After receiving a decision to grant permission to develop a detailed plan of the territory, the owner of the plot needs to order a geodetic survey of his plot and the territory within a radius of 50-100 m. from the plot, the next step will be to search and select a DPT developer.
