You decide to sell the house and the first thing you do is to see what documents you have for your own or inherited house. In order to sell a house in the ideal version, you must have a document certifying your right to own the house, I will tell you about the types of these documents a little later, this document must also include an inventory file or a technical passport for the house, and you must also have a document to sell the house which certifies ownership of a plot of land, there are also several types of such documents, all of them were issued by institutions at different times but are still valid now, I have already told about them in previous articles in this article and I will leave a link to the article in which they are described in detail .
Regarding the documents certifying the ownership of the house, these are:
- a certificate of ownership of the house, including from the time of the Soviet Union, it looks like it will be a sheet of A4 format paper yellowed from old age with a hammer and sickle at the top of the sheet, so this document has legal force on the basis of it and the new technical passport for the house and document with the cadastral number for the plot, information can be entered in the new register of property rights to immovable property
- a contract of sale, exchange, or donation concluded in accordance with the procedure established by law, the subject of which is immovable property, the rights to which are subject to state registration, or a real right to immovable property or its duplicate;
- a certificate of ownership of a share in the joint property of the spouses in the event of the death of one of the spouses, issued by a notary or a consular institution of Ukraine, or its duplicate;
- a certificate of the right to inheritance, issued by a notary or a consular institution of Ukraine, or its duplicate marked with a stamp on the back of the letter with the number of the entry in the register of deeds;
- certificate of acquisition of property from public auctions (auctions) issued by a notary and certificate of acquisition of property from public auctions (auctions), if public auctions (auctions) did not take place, or their duplicates;
When you have one of the above-listed documents certifying the right of ownership of a house, it is good, all you have to do is find a document certifying the right of ownership of a plot of land, a description of one of these documents is here. There are situations when there are documents for the house but not for the land plot, then there are two options or to start formalizing the ownership right to the land plot, this procedure can take up to three to five months, it depends on the frequency of sessions of the local council, which will grant permission for the transfer of ownership land plot and from the availability of a master plan of the city or village in which your house and land plot are located, but in most cases, and especially when there is a potential buyer, there is no time to wait, and there is a second option, how to sell a house under which the plot is not privatized. In order to sell a house with a plot under which it is not privatized, you need to assign a cadastral number to the plot, this procedure can take 5-8 working days, for this it is enough to contact the land management organization and order the production of technical documentation on establishing the boundaries of the land plot in kind on the site, agree on the boundaries with the neighbors and based on this land management project, the registrar of the dezhgeocadastre enters information about your plot into the cadastral map of Ukraine and assigns a cadastral number to your plot. But there is one nuance here, after buying a house, the buyer must arrange for himself a plot of land under the house within the limits of the norm of free privatization, therefore the buyer should not use his right to privatize the plot for residential construction, otherwise he will be forced to buy back the plot under the house from the local community and this is another procedure
